Legal aspects of network industries and natural monopolies

1 Summary Key words: Natural monopoly, network industry, energy industry, regulation, liberalization, unbundling, third party access The present thesis sets out to explore the legal aspects of network industries and natural monopolies. It researches these aspects using the example of the energy sector (i.e. the power and gas industries), which is a typical example of a network industry. In terms of its geographical scope, the thesis focuses on the EU energy law and its specific application in the Czech Republic. The fundamental point of departure for the present thesis is a believe that energy law is closely intertwined with economic policy, and is appropriately interpreted only in the context of the concrete measures, tools, and concepts meant to reflect a nation's energy policy. The main driver of energy policy, and hence also of energy law, is a reform of the energy industry aiming at its liberalization. The key tools for its successful implementation are economic regulation, third party access, unbundling, and public administration by independent regulatory bodies. Liberalization of the market versus network industry in state hands for example of postal service market and the Czech Post, state enterprise

Bachelor thesis is dealing with the liberalization of the postal service market in the Czech Republic. Thesis analyzes the selected issue in the practical part on the example of the Czech Post, state enterprise. It clarifies the areas and terms closely linked with the issue. Thesis also defines monopoly features and specifies the network industry. It deals with the privatization process, defines the essential features of the state-owned enterprise and other main business corporations. Text explains the theory of public choice and its related problems. It also focuses on postal license which commits to provide universal service. The aim of the thesis is to create a comprehensive overview of past and current state of the postal market. Another objective is to analyze Czech Post enterprise particularly its economic activity and legal form. It turns out that the Czech Post is not now as lossy as it appears in public. We can predict decreasing trend in the evolution of revenues in the future with the help of related graph. Thesis objectives are met by composing the general development of the legislative and institutional changes. We can compare the legal forms of institutions and the extent of branch networks in each country with the help of a comparative analysis of European postal institutions. The Czech Republic does well - it is below the average. This allows to set conclusions and recommendations for our market. We mainly used issues of Post Partner project to examine the future development of the Czech Post.
Public Utilities in the EU: Evaluation of Electricity Industry Regulation in the Czech Republic

The thesis scrutinizes public utilities (network industries) with focus on electricity market regulation. In the first part, a public utility is defined, including its economic characteristics and need for regulation. Within their regulation various models are introduced - in terms of level, voluntary/mandatory, ex ante/ ex post and branch of government. Further, the basic prerequisites for successful regulation are derived from the theory (independence, information capacity and trustworthiness). The second part is concerned only with electrical power industry with its characteristics, business model and regulation (both in the Czech Republic and in the EU). In the third part, an evaluation scorecard is created, which allows us to examine the quality of electricity regulators. The criteria in the scorecard are based on prerequisites (enforcement power, scale of resources, independence, dispute settlement, appeal procedure, transparency and consistency) and results (competition support, renewable energy resources and consumer protection). The model is applied to Energy Regulatory Office (Energeticky regulacni urad) in the Czech Republic.
Models and methods for network economies

The goal is to create a summary of models and methods for network economies including network structure, a dynamic and uncertain environment, factors more criteria in the network economy. Deeper deal with graph theory, networks and supply networks. Part of this work is the analytical part, where the patterns and using them I find the position of nodes in the network data from Lidé.cz and eBay. I demonstrate the models and calculations.
